Terms of sale

These terms govern Alfie Suite subscriptions and separately sold complementary products. They distinguish business customers from consumers and explain Alfie Credits, Business OS autonomy and immediate performance of the service.

1. Seller and scope

These terms are issued by Buzztron — Nathalie Staelens, sole trader, SIRET 904 321 932 00025, 41 rue Roger Salengro, 62000 Arras, France. Contact: contact@alfiesuite.com — +33 7 45 26 30 64.

They apply to Alfie Suite subscriptions, separately sold complementary products, services and options ordered online or accepted by quote. The Terms of Use, Privacy Policy and any special terms form part of the agreement.

A business customer purchases for professional purposes. A consumer purchases outside their trade or profession. Mandatory consumer protections apply only where the customer legally qualifies as a consumer.

2. Offers

Alfie Suite is a conversational marketing Business OS. The standard Alfie, Alfie Business and Alfie CEO offers share the same functional core and may include, where actually enabled, strategy, Brand Library, content creation, Radar, Prospecting, Acquisition, publication preparation, monitoring and steering. Commercial differences include the Alfie Credit allocation, number of brands, volume limits and autonomy level.

The autonomy level determines how far Alfie may prepare, orchestrate or propose actions. It does not remove the human validations required by the product for sensitive decisions, external commitments, spending, publication or irreversible actions.

Essential features, active capabilities, limits, price, billing frequency and restrictions are shown before payment on the offer page or quote. A future, experimental or unavailable feature is not part of the purchased service until it is officially activated.

3. Order and contract

The customer selects an offer, reviews the price and billing cycle, accepts the contractual documents and confirms payment. The order becomes binding after Stripe validates payment and confirms the subscription or purchase.

Buzztron may refuse or suspend an order that is fraudulent, technically inconsistent, unpaid or contrary to the usage rules. The customer warrants that billing information is accurate and that they are authorised to bind the organisation identified at checkout.

4. Price, tax and invoices

The applicable price is the one shown at checkout or in the accepted quote. Taxes and currency treatment appear in the payment flow and invoice according to the customer’s situation and applicable rules.

Payments are processed by Stripe. Invoices and receipts are supplied electronically.

Promotions and discount codes are governed by their own conditions and are not cumulative unless expressly stated.

5. Subscription, renewal and cancellation

Unless stated otherwise, subscriptions renew automatically at each monthly or annual term. Cancellation applies at the end of the paid period, subject to mandatory law or a more favourable commercial commitment.

Cancellation does not erase amounts already due or services already performed. Included allocations, capabilities and rights follow the cycle, renewal and any carry-over rules displayed for the relevant offer.

Price changes are communicated before they apply to a subsequent renewal. The customer may cancel before that renewal if they do not accept the new price.

6. Payment failure and suspension

Payment is due at order and renewal. Failed payments may be retried by Stripe and access may be limited or suspended after notice.

For business customers, late payment may trigger statutory penalties and recovery charges where applicable.

7. Consumer withdrawal rights

A consumer generally has fourteen days from conclusion of a distance contract to withdraw without giving a reason. This statutory right does not apply in the same way to customers purchasing exclusively for business purposes.

Where no substantive use occurred, Buzztron refunds the relevant amount in full within the statutory period. Merely viewing the account, without launching a Mission, executing a generation, consuming an Alfie Credit, exporting, downloading or obtaining another useful performance, is not substantive use.

Where the consumer expressly requested immediate performance and used the service, a proportionate amount for the service actually supplied up to withdrawal may remain due. Buzztron may take into account access duration, Missions launched, generations executed, Alfie Credits consumed and exports or deliverables obtained, and provides the calculation details.

Digital content supplied without a tangible medium may begin before the end of the withdrawal period only after the required express consent and acknowledgement. Withdrawal rights for that content may be lost where the statutory conditions are met and supply has begun or performance has been completed.

8. Immediate performance request

Checkout separately records a consumer’s request for performance to begin before expiry of the withdrawal period and their acknowledgement of the stated consequences.

The request, contractual version and date are retained with transaction metadata. A confirmation is supplied on a durable medium with the order information.

9. Refunds after withdrawal

Full refunds due after withdrawal are made within the statutory period using the original payment method unless another fee-free method is expressly agreed.

Where part of the service has already been supplied at the consumer’s express request, Buzztron may deduct the proportionate amount permitted by applicable consumer law. No punitive withdrawal fee is charged.

10. Alfie Credits and complementary purchases

Alfie Credits are internal units used to measure consumption of certain actions and productions in Alfie Suite. They are not money, a payment instrument, a deposit or a cash-redeemable balance and are not transferable, subject to mandatory law.

The included Alfie Credit allocation, allocation cycle and credit cost of relevant operations are displayed in the product or applicable offer. An operation that is actually executed may consume the stated credits; refunded or cancelled operations follow the service’s reservation, settlement and release rules.

Separately sold complementary products, including products with their own subscription or quota, do not create a second currency and are not added to the Alfie Credit balance as additional credits.

Rights or units historically acquired before migration to an Alfie offer remain preserved under the conditions that applied when acquired; they are not automatically deleted, converted or added to Alfie Credits without an explicit commercial rule or customer agreement.

11. Digital-service warranties

Consumers benefit from mandatory legal conformity warranties for digital content and services, including the remedies available where the service is defective.

Mandatory consumer remedies are not limited by any commercial warranty.

12. Liability and marketing outcomes

Buzztron provides a working system, assisted analysis and deliverables, but does not guarantee audience, conversion, revenue, SEO ranking or virality. Alfie indicators and recommendations are not promises of commercial results.

The customer remains responsible for final validation of decisions, legality of their offers, accuracy of published facts, rights in supplied material and actions they authorise towards third-party services. Human validations required by the product must not be bypassed.

Mandatory consumer rights are never excluded.

13. Complaints and consumer mediation

Complaints should first be sent to contact@alfiesuite.com so that an amicable solution can be sought.

After a prior written complaint remains unresolved, a consumer may use the competent consumer mediator free of charge: Médiateur à désigner avant l’ouverture des ventes aux consommateurs — Coordonnées à compléter.

The mediator name, address and website must be configured before B2C sales are effectively opened.

14. Governing law and jurisdiction

French law applies, without removing mandatory protections available to consumers in their country of residence.

Where no amicable solution or mediation is reached, disputes are brought before the courts having jurisdiction under applicable law. Special terms or a quote may specify jurisdiction for business customers where legally permitted.
